Agreement to the Terms

This term regulates the use of SCANDI-DIARY, assigning to the SCANDI-DIARY’s user (called USER) and implies full acceptance of its terms’ conditions when performing the installation of the application on your mobile device or even use the website www.scandi-diary.net.
Your access or use of any Service in any way signifies that you have read, understand and agree to be bound by the Terms. By accessing or using any Service you also represent that you have the legal authority to accept the Terms on behalf of yourself and any party you represent in connection with your use of any Service. If you do not agree to the Terms, you are not authorized to use any Service.


Object

SCANDI-DIARY provides USERS with access to various services and products related to their vehicles (automotive or not) registered in the system, called respectively SERVICES and PRODUCTS. Some of the services offered will only be able to be used by registering data relating to vehicles as well as user interactions.


Conditions of access and use

APPLICATION: expense management software for any vehicles or not.

SITE: website where information about the APPLICATION is made available, as well as links to download it in the stores of the various mobile platforms.

REGISTRATION: previous and necessary process for complete use of all services offered.

MY LOCATIONS: places registered by the USER and that will be used for calculations of distances traveled as well as in the ROUTE´s registers.

SUPPLIES: data registered by the USER of supplies made at his vehicle.

EXPENSES: USER registration of expenses incurred in his vehicles such as part replacement, taxes, insurance, fines, among others.

VEHICLE SERVICES: data registered by the USER of the services related to the maintenance of his vehicle such as parts, oil change, tires, among others.

REMINDERS: USER registration of expenses and services to be performed on his vehicle.

DISTANCE CALCULATOR: A calculation system that allows USER to determine which fuel is most advantageous for the supply of its motor vehicles and how much it will cost the route distance.

RECURRING TRIPS: The Recurring Trips allows users to schedule trips that repeat on a regular basis. These trips can have one of three statuses: Active, Paused, or Expired. Active: When a recurring trip is in Active status, it will automatically generate trips at the end of each day based on the setup. Paused: Users have the ability to change a recurring trip’s status from Active to Paused, temporarily halting the automatic creation of trips. Expired: The status will automatically change to Expired under specific conditions. For weekly recurring trips, the status will switch to Expired at the end of each week on Sunday. Users cannot manually set a recurring trip to Expired; this change is managed by SCANDI-DIARY. Please note that while users can toggle between Active and Paused, only the SCANDI-DIARY system can change a recurring trip’s status to Expired. Once is Expired, it will no longer generate new trips.

PREMIUM VERSION: paid version that allows to export reports, more options of graphics and priority service and etc., among other advantages, by means of monthly or annual payments.


Guest User Policy

Guest Access and Data Retention

  1. Users may choose to enter the app as a guest without registering or logging in.

  2. Due to security reasons, guest users are required to access the app at least once every 30 days.

  3. If a guest user fails to access the app within this period, access to their data may be lost.

Data Recovery for Guest Users

  1. In the event that a guest user loses access to their data, they must contact us via email at scandisoftapps@gmail.com to request data recovery.

  2. We will make reasonable efforts to assist in the recovery of data, but we cannot guarantee the restoration of all lost data.

Account Archiving

  1. If a guest user has not accessed the app for a period of 3 months, their account and data may be archived.

  2. Once an account is archived, it cannot be restored, and all associated data will be permanently lost.

Registered Users

  1. We strongly recommend that users register for an account to ensure continuous access to their data and avoid potential data loss.

  2. Registered users will not be subject to the 30-day access requirement and will have their data securely retained as per our data retention policy.


Provision of Services Generally

Free Trial Period

SCANDI-DIARY may provide you with an option to use the Premium Services on a free trial basis. Once such free trial period expires, access to the Premium Services will be suspended until you upgrade to a paid account. SCANDI-DIARY reserves the right to modify the duration of, or to terminate, the free trial period at any time.


SCANDI-DIARY offers paid memberships to our Premium Services. The paid memberships are not auto-renewing meaning that the user pays once for the selected period. When this period ends, your account will switch back to normal and you will not be able to manage more than 1 vehicle unless you buy Premium version again. You agree that any notices, agreements, disclosures or other communications that we send you electronically will satisfy any legal communication requirements, including that such communications be in writing.


All fees are non-refundable

No refunds for periods of inactivity will be issued.


Intellectual property

The contents of this application and the website, texts, images, icons and others, as well as the trademark SCANDI-DIARY, are protected by Danish law and by foreign law. Reproduction, edition, distribution, or use of any information contained in this application or website outside its original scope requires the written permission of the owners´s website or the content in question. Downloads and copies of this application are allowed only for private use and for the benefit of users, both individuals and corporations. Any acts or contributions intended for decompilation, reverse engineering, features´modification, enhancement, alteration, merging or incorporation of SCANDI-DIARY or the website in any other programs, systems or sites are forbidden.


User suspension for inappropriate behavior

User Conduct

1.1. Inappropriate Behavior: You must behave in a responsible and respectful manner while using our system to interact with other Users. Any behavior deemed inappropriate by the administrators, including but not limited to the following actions, may result in suspension:

a. Posting or sharing content that is defamatory, obscene, abusive, offensive, or harassing to other users or third parties. b. Engaging in any form of hate speech, discrimination, or promoting violence. c. Spamming, phishing, or engaging in any other form of fraudulent activity. d. Violating intellectual property rights, including copyrights and trademarks, by posting unauthorized content. e. Impersonating another individual, entity, or misrepresenting your affiliation with any person or organization. f. Breaching the privacy of other users or disclosing personal information without consent. g. Disrupting or interfering with the proper functioning of the Blog or its community. h. Engaging in any other conduct that is deemed inappropriate at the discretion of the administrators.

User Suspension

2.1. Suspension Policy: If your behavior is found to be in violation of these Terms, the administrators reserve the right to suspend your access to the Community section (Vehicle Services and Q&A). The duration of the suspension will be determined based on the severity of the violation and the administrator’s judgment.

2.2. Suspension Notification: If your account is suspended, the administrators will provide a notification explaining the reasons for the suspension and the duration of the suspension period. The notification will be sent to the email address associated with your account or through any other contact information you have provided.

2.3. Appeals: If you believe your suspension was unjust or based on a misunderstanding, you may submit an appeal to the administrators. Appeals must be made in writing and include a detailed explanation of your position. The administrators will review the appeal and respond within a reasonable timeframe.

Modifications and Termination 3.1. Modification of Terms: The administrators reserve the right to modify or amend these Terms at any time. Such modifications will become effective immediately upon their posting on the website/system. It is your responsibility to review the Terms periodically for any changes.

3.2. Termination: The administrators may terminate your access to the Community section (Vehicle Services and Q&A) at any time and for any reason without prior notice. Upon termination, you will no longer have access to the Community section (Vehicle Services and Q&A).


Limitation of Liability.

Except to the extent required by applicable law and then only to that extent, in no event will SCANDI-DIARY, its employees, officers, directors, affiliates or agents be liable to you on any legal theory for any incidental, direct, indirect, punitive, actual, consequential, special, exemplary or other damages, including without limitation, loss of revenue or income, lost profits, pain and suffering, emotional distress, cost of substitute goods or services, or similar damages suffered or incurred by you or any third party that arise in connection with the Services (or the termination thereof for any reason), even if SCANDI-DIARY Parties have been advised of the possibility of such damages.

The SCANDI-DIARY Parties shall not be responsible or liable whatsoever in any manner for any content posted on the Websites or Services (including claims of infringement relating to content posted on the Websites or Services, for your use of the Websites and Services, or for the conduct of third parties whether on the websites, in connection with the services or otherwise relating to the Websites or Services.


Indemnification

You agree to indemnify and hold harmless the SCANDI-DIARY Parties (defined above) from and against any and all loss, expenses, damages, and costs, including without limitation reasonable attorneys fees, resulting, whether directly or indirectly, arising out of your use of the Services, including but not limited to your violation of this agreement or the Terms. You also agree to indemnify and hold harmless the SCANDI-DIARY Parties from and against any and all claims brought by third parties arising out of your use of any of the Services and the content you make available via any of the Services by any means, including without limitation through a posting, a link, reference to content, or otherwise.


The links contained in the APPLICATION will direct USER to third-party websites or applications or partners. We, however, do not control the content of these sites from third parties and partners, and can not guarantee the fidelity of the information they provide. Web providers and app/websites managers are responsible for their own content.


User obligations

The USER undertakes to use SCANDI-DIARY according the law, this service term, and the privacy policy, in addition to other standards and undertakes not to reproduce, copy, distribute, transform or modify the contents, unless it has the prior authorization of the holder of the corresponding rights or is legally permitted.


Privacy

Your privacy is important to us and we are committed to protecting it.

This Privacy Policy describes how we collect, use, store, share and protect your information both on our digital platform and with our partners. This Privacy Policy applies when you install the application, access any of the platforms, visit or use any of the services provided. This document is governed by the terms of service set forth in the Terms of Service located at www.scandi-diary.net.

By creating an account or simply accessing the platform, you expressly agree to the collection, use, disclosure and retention of your information as described in this document.

If you purchase or access the Service through a third-party service that provides the application in your environment or only a link to the application on our servers, you will have a separate and additional account relationship with these third parties and this information will be treated accordingly their privacy policy agreed with them, and we have no relation of representativeness with these services, being entirely responsible for the use.

If you don´t agree to any changes occured in this Privacy Policy, you may close your account and the corresponding data to it.

  1. Information collected by SCANDI-DIARY: we may collect and store any of the information provided with account creation, profile completion, registration of vehicles, registration of services or any use of any of our services as well as contact by email or any other channel.

  2. Information that you share in the service: Some of the information will be shared with other users of the services, such as your profile picture, your username, your opinions and comments about a service or partner, but we will not share personal data, such as registration numbers or public documents, your contact details and simillars.

  3. Information automatically collected through the service: We may automatically collect information about you when you use the Service. If you access the Service through a mobile device, we will collect information about your geographic location, including the geographic location relative to third-party merchant locations. In addition, we may collect information such as the type of device, IP address, system version used, statistics for viewing pages and services, and the use of features, functions, or notifications on the device, even if you do not have an account created. If you access the Service through a computer, we may collect information such as your browser type and version, computer and connection information, statistics on pageviews, traffic to and from the service, IP address, and standard web log information. If you use the Service through a mobile device and you do not want us to collect your location information, change your preferences through the feature on your mobile device by disabling it. However, by doing this, some of the features of the Service that depend on location will not work well.

  4. Cookies: We may collect information automatically when you use the Service using “cookies”. Cookies are small amounts of data that are stored in your computer’s Internet browser and are accessed and logged by the sites you visit so they can recognize the same browser by browsing online later. Information that may be collected by cookies when you use the Service may include, without limitation:
    • The pages you visit on the Service;
    • The date and time of your visit to the Service;
    • The amount of time you spent using the Service;
    • The Internet Protocol (IP) address used to connect your computer to the Internet;
    • Your computer and connection information, such as your browser type and version, operating system, and platform. You can set your browser to reject cookies or notify you when you send a cookie. However, if you disable cookies, you may not be able to use all features of the Service, including those features that are only available to registered members of the Service.

  5. Information provided by social networking services: By logging into the Service through a third-party social networking service such as Facebook or Twitter, you give us permission to access, store and use any information that enables the network service third-party social networks to share with us according to the privacy settings that are applicable to your account with this social network service. We encourage you to review and, if necessary, adjust your privacy settings to the applicable social networking service before logging into the Service through a social networking service. The information we receive from a third-party social networking service is stored and used by us in accordance with this Privacy Policy.

  6. Collection of information by third parties: If your access happens through third parties, the data collected by them may be used in accordance with their privacy policies and terms of service, and SCANDI-DIARY is not responsible for any bad use of this information. The use of social networks from SCANDI-DIARY, as well as their privacy, will depend solely and exclusively on the configuration of privacy configured in these social networks. We encourage you to review the privacy policies and settings on the social networking sites you interact with to make sure you understand the information that may be collected, used, and shared by those sites. SCANDI-DIARY may include third-party advertising, links to other sites and other third-party content that will be generated based on your behavior, and there is no sharing of your personal information on SCANDI-DIARY. Only behavioral data, grouped, can be shared, so any user´s data can be identified. These sites, third-party advertisers and companies, or advertising companies working on your behalf, can use beacons and cookies to measure the effectiveness of your ads, customize or optimize advertising content, and track users who click on the links made available through the service. These third parties may use cookies and web beacons to track the actions of users online over time and on different websites or platforms to provide targeted electronic ads to an individual user.

  7. Use of information by SCANDI-DIARY: We may use the information we collect about you through the Service to:
    • Provide access to the Service and provide you with requested services and customer support in addition to processing and answering your questions;
    • Customize, measure and improve our services, content and advertising and otherwise enhance your experience with the Service;
    • Prevent, detect and investigate potentially prohibited or illegal activities and enforce the SCANDI-DIARY Terms of Service;
    • Analysis of the accuracy, effectiveness, usability or popularity of the Service;
    • Generate and analyze reports and data about the user base and service usage patterns;
    • Compile aggregate data for internal and external business purposes;
    • Resolve disputes and solve problems;
    • Contact us through any of the channels you have registered with information, promotional, marketing and advertising and recommendations that we believe may be of interest to you;
    • Provide you with other services requested by you as described when we collect the information;
    • Offer products and services that we consider relevant, according to their behavior or insertion of information;
    • If you use the Service on a mobile device, we may send “push notifications” to your mobile device to provide updates about the Service and other relevant messages.

  8. Disclosure of information to third parties. SCANDI-DIARY will not disclose individualized information to trading partners.

  9. Sending information and displaying ads from our partners: All communication by e-mail will comply with ABEMD rules, so there will be no SPAM. If you no longer wish to receive our communications by email, simply select this option in one of the shipments that we make. Regarding bid notifications, they should be disabled in the Settings area of ​​your Android or iOS. If you detect any SPAM, please contact us at scandisoftapps@gmail.com.

  10. Place of information storage: your information will be stored on a cloud for a better synchronization between the platforms and also to prevent loss of your data if you change your device.

  11. DELETE DATA: The user can delete all his data by navigate to screen: “Profile” and click on the button “Delete Account”, without the need to contact support. This action is irreversible and you will no longer be able to access your account and data. In order to bring best experience for our users, some of our Services cannot be removed after the user has deleted his account (Questions and answers, reviews on vehicle services sections), in such cases where we need to show data from the user, we just display “Deleted user”.

  12. Additionally, please note that the security of user-uploaded images is of utmost importance to us. All images are securely stored in the cloud, and every time a user requests to view an image, they receive a unique link that expires after approximately 1 minute. This ensures that only authorized users can access the images and mitigates the risk of unauthorized access to our cloud data.


Updates

SCANDI-DIARY updates both the APPLICATION and the SITE in order to provide performance improvements, bug fixes and new functionality, but there is no specific periodicity depending on the sole and exclusive decision of its managers.

The download of the APPLICATION or access to the SITE and its updates implies the tacit acceptance of this service term.


Penalties

The use of the APPLICATION or SITE improperly, in disagreement with this term, may lead to the exclusion of the USER as well as other legal sanctions envisaged and the reimbursement of any damages resulting from this misuse.
